Personal Data Protection in accordance with the General Data Protection Regulation (GDPR)
Information on Personal Data Processing is provided in accordance with the Law on Personal Data Protection (“Official Gazette of Montenegro”, No. 079/08 of 23.12.2008, 070/09 of 21.10.2009, 044/12 of 09.08.2012, 022/17 of 03.04.2017)
Pursuant to the Law on Personal Data Protection (“Official Gazette of Montenegro”, No. 022/17), Bromar Insurance Brokerage Company, located at Marka Radovića 175, Podgorica (hereinafter: the Company), hereby sets out the following information on the processing of personal data.
Handling of Policyholder and Insured Parties’ Personal Data
Personal data is obtained directly from the policyholder or insured party whether an individual or a legal entity based on their consent. This takes place during the brokerage’s activities aimed at securing insurance or reinsurance terms, in accordance with legal requirements, for the purpose of entering into an insurance contract. Additionally, such data may be collected throughout the validity of the insurance agreement, or upon subsequent request from the chosen insurer or reinsurer, if further documentation is needed either to obtain insurance terms or to manage an existing insurance contract during its duration.
Purpose of Processing, Legal Grounds, and Data Retention
The Company processes all personal data of policyholders and insured parties to facilitate the procurement of insurance or reinsurance terms, where required by law, and to support the conclusion of insurance contracts. Such processing is carried out exclusively within the scope of the Company’s licensed business activities. Personal data collected for these purposes is stored, in accordance with legal requirements, for the entire duration of any insurance contract in which the Company has acted as an intermediary.
Compliance with Anti Money Laundering and Counter Terrorism Financing Legislation
In accordance with its obligations under the Law on the Prevention of Money Laundering and Terrorist Financing, the Company processes personal data relating to policyholders, insured parties, insurance beneficiaries, authorized representatives, legal guardians, and, in the case of corporate clients, ultimate beneficial owners. This data processing is carried out exclusively for the purpose of fulfilling statutory requirements.
Personal data collected for these compliance purposes is retained in line with all applicable legal and regulatory provisions.
Data Access and Disclosure
Access to personal data is restricted to employees whose roles require such information, as well as to insurers and reinsurers, as necessary for the Company to fulfill its registered insurance brokerage activities and to facilitate the arrangement and administration of insurance contracts. Furthermore, personal data may be shared with third parties who are legally authorized to access such information under applicable law.
Data Security
All personal data processed by the Company is treated as strictly confidential and is protected as a business secret, whether stored electronically or in physical form. Robust technical and organizational measures are implemented in accordance with applicable laws and the Company’s internal policies. All data is stored on secure workstations located within the Company’s premises. Access is controlled and limited to authorized personnel via a shared drive with restricted permissions.
Data Protection Rights
Policyholders and insured parties are entitled to exercise all rights granted under applicable data protection legislation. These rights include: the right to access personal data, request rectification, completion, or erasure of data, the right to restrict processing, the right to object to processing, and the right to data portability.
The Company may charge a reasonable fee to cover necessary costs for producing additional copies of personal data requested by the policyholder or insured party . If a request is made for copies to be provided electronically, the information will be delivered in a commonly used electronic format, unless the policyholder or insured party requests otherwise.
